A few things to point out (see Aikens statement to the press):
Clay was sleeping on a small commuter plane (he is a big guy at 6' 1")
His foot "wandered" onto the armrest of the seat in front of him
He woke up as the "lady" was yelling and hitting him in the chest
The FBI was brought in because this is technically assault and battery
Clay declined to press charges.
