Gene Simmons' Lawyer Confirms Authenticity of Sex Tape

With the alleged release of a Gene Simmons sex tape, the blog-o-sphere has been going wild with reports. However, Barry E. Mallen, Simmons' legal counsel, has confirmed, through an email to Owen Thomas the managing editor at valleywag.com, that the tapes are indeed the Kiss bassist and were taped without his knowledge by Traci Anna Koval. The statement further explains that the copyrights of the tape were acquired in a written agreement from Koval by Allied Industry Tours, Ltd.

Simmons and his legal representation are demanding a cease and desist on all streaming of the film from the website which has been charging users to view the scandalous tape. Futhermore, Simmons is demanding all profits earned from the online stream, as well as the legal fees incurred by Simmons, be paid to the Kiss member.

The email also demands penalties be paid for the usage of Gene Simmons name and likeness on the Web site as it violates California's right of publicity statue. Finally, the email requires that the website in question reveal the source by which they received a copy of the sex tape as the written agreement with Koval warranted that no copies existed.
