Apparently that excuse holds it's water in court; prosecutors are dropping the charges agreeing that Doherty was indeed too inebriated to have committed the crime. The ruling is a tragically lucky break for Doherty who was released from prison earlier this summer after doing time for cocaine possession. He would have faced five more years in prison had he been convicted of the theft.
Doherty was in Germany filming scenes for the French Alfred de Musset biopic 'Confessions of a Young Contemporary' with Charlotte Gainsbourg. The filming has been stalled several times due to Doherty's ongoing legal troubles.

So perhaps now all those old Nazis the Germans are trying to find and prosecute, can use the "I was too drunk to have killed anyone" defense and get away with murder. The German court system seems to be as screwed up as ours! The idiot caused property damage, stole a guitar, and was also guilty of public drunkeness. He should have gotten 5 years. No one would miss him. We have enough drunks and drug addicts with guitars being idolized as it is.

Or, if you did commit the crime, then you couldn't have been that drunk. This will certainly change the character of alcohol-related offenses, for many years to come.
