McCarty was first apprehended in 2008 at the Hilo airport in Hawaii when photos of nude children fell out of his bag while a TSA officer examined it. Further investigation uncovered more than 400 still images and 200 video clips of child pornography stored on his laptop and external hard drive.
McCarty admitted to having sexual relations with three children aged 11, 10 and 6. Two of the victims were from the U.K. and the third was from Nepal.
"All the production did happen outside the U.S. -- the U.K. and other places," his defense attorney William Harrison said. "The problem is you can't under U.S. law actually bring or transport those photographs and/or videos into the U.S. and possess them."
His attorney also had the gaul to deliver the non-defense that the encounters "were all consensual, although at that age you can't consent to it," and that, "There was nothing that was any type of physical type of duress."
Yardbird Jim McCarty gave no comment on his son's plea.
